1. Acceptance of Terms

By accessing or using Maryjane ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

  • Age Requirement: You must be at least 21 years of age or the legal age for cannabis-related content in your jurisdiction, whichever is greater. By using the Platform, you represent and warrant that you meet this requirement.
  • Legal Compliance: You are solely responsible for determining whether your use of the Platform and any cannabis-related activity complies with the laws of your jurisdiction. The Platform does not encourage, facilitate, or condone any activity that is illegal under applicable local, state, or federal law.

3. Federal Law Disclaimer

Cannabis remains a controlled substance under federal law in the United States. Nothing on this Platform should be construed as encouraging, promoting, or facilitating the purchase, sale, possession, or use of cannabis where prohibited by law. The Platform is a personal data-tracking tool. Users are solely responsible for ensuring their own compliance with all applicable laws, including federal, state, and local regulations.

4. Account & Access

  • One Account Per User: You may only create and maintain one account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Account Termination: Maryjane reserves the right to suspend or terminate any account that violates these Terms, at our sole discretion, with or without notice.
  • Account Recovery:Account access may be recovered through the Platform's password reset functionality.

5. User Responsibilities & Prohibited Conduct

  • You agree not to use the Platform for any unlawful purpose or in any way that violates these Terms.
  • You agree not to engage in spam, harassment, abuse, impersonation, or fraudulent activity.
  • You agree not to attempt to gain unauthorized access to any part of the Platform, its systems, or other users' accounts.
  • You agree not to reverse engineer, decompile, or disassemble any part of the Platform.
  • You agree not to use automated scripts, bots, or scraping tools to access or extract data from the Platform.

6. Intellectual Property

  • Platform Ownership: The Platform, including its design, code, branding, features, and all related intellectual property, is owned by Maryjane and protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial purposes in accordance with these Terms.
  • User Data Ownership: You retain ownership of all data you input into the Platform (e.g., session logs, product entries, preferences). By using the Platform, you grant Maryjane a limited license to store, process, and display your data solely to provide the services described herein.

7. No Medical, Legal, or Professional Advice

The Platform does not provide medical, legal, therapeutic, or any other professional advice. All insights, correlations, recommendations, and information presented by the Platform are generated from user-submitted data and are for informational and personal tracking purposes only.

  • You should not rely on the Platform as a substitute for professional medical advice, diagnosis, or treatment.
  • You are solely responsible for your own consumption choices and any consequences thereof.
  • Product details, effects, and insights should be independently verified by you.
  • If you experience adverse health effects, seek immediate medical attention — do not rely on the Platform for guidance.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. MARYJANE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

MARYJANE MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR USEFULNESS OF ANY INFORMATION, INSIGHT, OR RECOMMENDATION PROVIDED THROUGH THE PLATFORM. ANY RELIANCE ON SUCH INFORMATION IS STRICTLY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MARYJANE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF MARYJANE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL MARYJANE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO MARYJANE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Maryjane, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including any cannabis-related laws; or (d) your violation of any third party's rights.

11. Third-Party Services

  • External Terms Apply: The Platform relies on third-party services (e.g., Supabase for data storage and authentication). Your use of these services is subject to their respective terms and privacy policies.
  • No Third-Party Liability: Maryjane is not responsible for outages, data loss, security incidents, or service interruptions caused by third-party providers.

12. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
  • Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Florida.
  • Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.
  • Exceptions: Notwithstanding the above, Maryjane may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to address fraud, abuse, or security threats.

13. Modifications to Terms & Service

  • Updates to Terms: Maryjane reserves the right to modify these Terms at any time. Material changes will be communicated via in-app notification. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
  • Service Changes: Maryjane reserves the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice, and without liability to you.

14. Force Majeure

Maryjane shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, power outages, third-party service disruptions, cyberattacks, pandemics, or other force majeure events.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Maryjane regarding your use of the Platform and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied.
